Older People's Care Homes Contract and Commissioning Team (Social Care)

The team is responsible for the contract management and monitoring of older people's care homes across Leeds. Working in partnership with care providers, we aim to deliver safe, responsive care within the best possible quality services for Leeds residents.

This webpage provides information, guidance and resources for care home managers and providers supporting people aged 65 and over. It includes information about the Leeds City Council Overarching Agreement Contract, care home placements and finances, compliments and complaints, safeguarding, digital and ICT services, and training opportunities for social care staff.

Overarching Agreement for the Provision of Residential Social Care

The Leeds City Council Overarching Agreement for the Provision of Residential Social Care (Scheme ID 88110) is a contractual framework for care home providers. The agreement consists of seventeen (17) guidance documents, designed to support contract compliance, service quality and the effective delivery of care. These documents are to be read in conjunction with the Provisional Care Home Individual Service Agreement (PCHISA) which a care home will receive separately, and form the contract for the placement with Leeds City Council.

The contract start date is 1 December 2024 with a completion date of 30 September 2028.

Spot Overarching Agreement for the Provision of Residential Social Care

The Leeds City Council Spot Overarching Agreement for the Provision of Residential Social Care (88110) is used for individual care home placements where the care home provider is not part of the Council's Overarching Agreement or where a placement is required out of the Leeds City region. The Spot Contract, together with the Care Home Individual Service Agreement (CHISA), forms the contractual framework for the specific resident placement. The supporting six (6) documents provide guidance on service requirements, contractual terms and conditions, nursing care arrangements, complaints processes and additional support provisions. The contract start date is 1 December 2024 with a completion date of 30 September 2028.

Care home placements and finance arrangements

Placement financial arrangements

As a care home manager or social worker, you must discuss financial arrangements with residents and families before any decision is made on them moving into a care home. Ideally, care homes will produce an information pack or brochure for residents and families, which should explain all aspects of care, including finances. The Finance Overview document provides a summary of the key information and considerations to support these discussions. 
 

Care home managers should also give residents and families a copy of the latest Leeds City Council 'How To Pay Your Care Home fees booklet', which also provides information about care home finances.

Compliments and complaints

Complaint handling

For complaints handling, we ask that care home managers read the Joint Protocol on Complaints Handling between Leeds City Council Adults and Health Directorate and their commissioned service providers. 

As a care home manager, when you receive a complaint from or about a Leeds City Council funded resident aged 65 or over, please send a draft response to your allocated Leeds City Council senior commissioing officer before sending it to the complainant.

Monthly returns

Each month, care home managers should record details of the compliments and complaints a care home has received during the previous month. Please record this information on the Complaint and Compliment Monthly Return Template Sheet and send this completed document to olderpeoplescarehomes@leeds.gov.uk and complaints.socs@leeds.gov.uk. 

When a resident arranges and pays for their own care and has not had a financial assessment, you do not need to include their details of any compliments or complaints in your monthly returns.

If Leeds City Council arranges the resident's care any compliment and/or complaint must be included in your monthly returns, even if the resident pays for their own care.

Safeguarding

Safeguarding responsibilities - care home manager and provider

Safeguarding is the term used for a range of measures employed to keep children, young people and adults at risk safe and protected from harm. All organisations have a duty to ensure that their safeguarding responsibilities are understood and embedded within their organisational structure. All staff, including volunteers, must know what to do if they are concerned about the safety and welfare of anyone they come into contact with as part of their work. 

As a care home provider, please ensure that you and your staff are familiar with the safeguarding policies and procedures of the Leeds Safeguarding Adults Board (LSAB). Further information can be found on the Leeds Safeguarding Adults Board website.

Please make sure that everyone working on this contract or project can recognise the signs of abuse and neglect in adults at risk and knows how to respond appropriately. This can be achieved through induction and training.

If you suspect that an adult at risk is experiencing abuse, you must report it in line with the procedures published by the Leeds Safeguarding Adults Board (LSAB).

If you suspect that an adult is at risk of harm, or is being harmed, contact the Adults and Health Contact Centre on 0113 222 4401 during office hours (9.00am to 5.00pm).

Outside office hours, including evenings, weekends and bank holidays, contact the Emergency Duty Team on 0113 378 0644.

In an emergency, call 999.

Adult social care referrals and safeguarding concerns

Care home managers should contact your Leeds City Council safeguarding and risk manager if you have any questions about safeguarding. 

Safeguarding decision support tool

It is the responsibility of provider services to ensure that practice or quality of care issues are addressed proactively and effectively through internal processes, ensuring that required standards of care are provided.

Care home placement cancelation process

Care home cancelling a CHISA

If a care home wishes to cancel a Care Home Individual Service Agreement (CHISA), Leeds City Council will arrange for the resident to move as soon as possible but not more than six (6) weeks following receipt of written notice from the care home.

The Council has the right to cancel a Care Home Individual Service Agreement (CHISA), by serving a seven (7) day written notice on the Care Home Provider in any of the following circumstances: 

  • If in the sole opinion of the Council the Services are no longer required for a particular Resident. 
  • Where the Resident discharges themselves from the Accommodation or has indicated that they no longer require the Accommodation. 
  • Where in the opinion of the Council the Provider is not able to meet the needs of the Resident and/or has not achieved the stated outcomes.

ICT and Digital

The Capacity Tracker

We recommend that care homes register multiple users for the Capacity Tracker. There is no charge for additional user accounts, and having more than one registered user helps support business continuity. If a member of staff is unavailable, another authorised colleague can continue to access the Capacity Tracker and submit any required information. This helps ensure that your organisation can maintain access to the system and meet any reporting requirements when needed.

Please note that the Capacity Tracker can only be accessed from within the UK. If your only registered user is travelling or working outside the UK, they will not be able to access the system.

Updating the Capacity Tracker

As a care home manager, please update the vacancy information on the Capacity Tracker and complete the Department of Health and Social Care mandated monthly returns. 

Regularly, updating the Capacity Tracker can assist your care home to appropriately fill your vacancies.

Department of Health and Social Care mandatory questions

The Adult Social Care Information (Enforcement) Regulations 2022 came into force on 1st December 2022. It requires all Adult Social Care providers, regulated by the CQC, to update the mandated collection in the Capacity Tracker.

The reporting windows are open between the 8th and 14th day of each month or the next working day when the 14th is on a weekend or public holiday.

Data Security

Each health and care organisation is expected to implement the 10 National Data Guardian (NDG) standards for data security. These standards are designed to protect sensitive data, and also protect critical services which may be affected by a disruption to critical IT systems (such as in the event of a cyber attack). NHSmail

Ideally, care homes managers will use their NHSmail account when sending any confidential, sensitive information, or attachments to olderpeoplescarehomes@leeds.gov.uk. If you require a new NHSmail account, please contact helpdesk@nhs.net.

Training

Workforce Development team

The Workforce Development team provides Adult Social Care recruitment, training, and development opportunities for independent and voluntary sector social care providers in Leeds.

This training is provided online and/or in-person, and training courses may be free of charge.

The Leadership Academy

The Leadership Academy provides a dedicated development offer for registered managers, deputies, aspiring managers, and supervisors, employed across the care sector.

Training opportunities include the delivery of six nationally recognised Skills for Care training opportunities, including three programmes and three modules for current and aspiring adult social care leaders.

ASC Brokerage team

The Leeds City Council Adult Social Care (ASC) Brokerage team help to promote the safety and wellbeing of Older Adults of Leeds through the brokerage of care home placements based on assessed individual need, personal choice, and personal budget.  The ASC brokerage service works collaboratively with residents, providers and professional stakeholders to achieve better outcomes for the people of Leeds.

Leeds Community Health Care Homes Pharmacy Team

As a care home manager and/or provider, the Leeds Community Health Care Homes Pharmacy Team (formerly the ICB Medications Optimisation Team) can provide you with free advice, support and an external audit to help support the administration, storage and recording of medications.

The We Care Academy

The We Care Academy is a successful recruitment and retention programme delivered by Leeds City Council. The We Care Academy provides the Step into Care programme and aims to support individuals with the right values, attitudes and behaviors to make the first step into their social care career. This is a free initiative available to all Adult Social Care Providers in Leeds.

As an employer, the We Care Academy will do the following:

  • Carry out right to work checks 
  • Obtain and check IDs 
  • Complete and pay for an enhanced portable DBS

Equipment responsibilities (provider vs LCC/NHS)

Resident in receipt of Council funding

When a resident is Leeds City Council funded, the care home is expected to provide equipment unless it is bespoke / one off. Bespoke equipment is specially made for one resident and cannot be used by anyone else.
