On 27 March 2025 an Inspector appointed by the Secretary of State for Environment, Food and Rural Affairs confirmed with modifications the above-named Order made under Section 257 of the Town and Country Planning Act.
The effect of the order as confirmed is to divert the public footpath commencing from a point, SE 29153 29356, at the junction with the continuation of Leeds Footpath No. 207 on Gipsy Lane, adjacent to 45 Gipsy Lane and proceeding for a distance of 338 metres to a point, SE 29481 29410, 4.0 metres to the west of it’s junction with Leeds public footpath No. 213, to a new line running from a point, SE 29154 29298, at the junction with the continuation of Leeds Footpath No. 207 on Gipsy Lane, and proceeding for a distance of 451 metres to a point, SE 29481 29410, 4.0 metres to the west of the junction of Leeds public footpath No. 207 with Leeds public footpath No. 213, as shown on the Order Map

This order comes into force from the date on which Leeds City Council certify that the provisions of Article 2 to the order have been complied with but if any person aggrieved by the order desires to question its validity or that of any provision contained in it on the ground that any requirement of that Act or any regulation made under it has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under Section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of Schedule 14 to that Act.
Notice of public path diversion order
This Order is made by Leeds City Council (‘the Authority’) under Section 257 of the Town and Country Planning Act 1990 because it is satisfied that it is necessary to divert part of a public footpath to which this Order relates in order to allow development to be carried out in accordance with planning permission granted under Part III of the Town and Country Planning Act 1990, namely a new 3G pitch and tennis courts and associated fencing up to 4.5 metres high, for Cockburn School, on the former South Leeds Golf Course, planning application reference 22/01376/FU.
By this order:
- The footpath over the land shown by a bold black line on the attached map and described in Part 1 of the Schedule to this Order (‘The Schedule’) shall be diverted as provided below.
- There shall be created to the reasonable satisfaction of Leeds City Council an alternative highway for use as replacement for the said footpath as provided in Part 2 of the Schedule and shown by bold black dashes on the attached map.
- The diversion of the footpath shall have effect on the date which Leeds City Council certify that the terms of Article 2 have been complied with.
- Where immediately before the date on which the footpath is diverted there is apparatus under, in over, along or across it belonging to statutory undertakers for the purpose of carrying on their undertaking, the undertakers shall continue to have the same rights in respect of the apparatus as they then had.
Schedule part 1 - Description of Site of Existing Path or Way
Leeds public footpath no. 207
A public footpath commencing from a Point A, SE 29153 29356, at the junction with the continuation of Leeds Footpath No. 207 on Gipsy Lane, adjacent to 45 Gipsy Lane and proceeding for a distance of 338 metres in an east-north-easterly, then easterly, then east-north-easterly direction on an earth surface to a Point B, SE 29481 29410, 4.0 metres to the west of it’s junction with Leeds public footpath No. 213. The footpath has a width of 1.2 metres.
Schedule part 2 - Description of Site of Alternative Highway
Leeds public footpath no. 207
A public footpath commencing from a Point C, SE 29154 29298, at the junction with the continuation of Leeds Footpath No. 207 on Gipsy Lane, approximately 55 metres to the south of Point A and proceeding for a distance of 451 metres in a generally east-south-easterly, then south-easterly, then north-easterly, then north-north-easterly direction on a Flexipave surface to a Point B, SE 29481 29410, 4.0 metres to the west of the junction of Leeds public footpaths Nos. 207 and 213. The footpath has a width of 3.0 metres.
