Licensing Act 2003 – Section 53A, public notice of application for summary review of premises licence

An application has been made to Leeds City Council for a Summary Review of the above licence.
The grounds for review are that in the opinion of a senior police officer the premises are associated with serious crime, serious disorder, or both.
Over a 4 week period (approx.) West Yorkshire Police have had to attend the premises in relation to three incidents, involving fighting, "mass brawling", the use of weapons, the use of a vehicle as a weapon and numerous arrests. One incident at the premises has been classified as attempted murder.
These incidents sit against a backdrop of complaints to West Yorkshire Police and other agencies, and concerns are expressed about the Premises Manager's ability to operate the premises whilst upholding the Licensing Objectives.
Given the incidents, West Yorkshire Police feel the Prevention of Crime & Disorder and Public Safety is not being maintained.

Notice is hereby given that Home Office Immigration Enforcement have made an application under Section 51 of the Licensing Act 2003 to carry out a review of the premises licence in force at the premises known as:
Charcoal Chicken, 188B Roundhay Road, Leeds, LS8 5PL
The application to review the licence relates to the Prevention of Crime & Disorder licensing objective.
In summary, the grounds for the review are:
On 26 September 2024 an enforcement visit was conducted at the premises following an illegal working allegation. In total, four members of staff were arrested as illegal workers, out of a total of six workers encountered at the premises.
During interviews concerns were also raised regarding the wages paid to the workers, raising serious questions about the licence holder's commitment to lawful and ethical employment practices.
The application explains such offences can only be committed with the co-operation of a premises licence holder or its agents.
Responsible authorities and other people may make written representations to Leeds City Council about this review between 16 December 2024 and 12 January 2025, to Entertainment Licensing, Leeds City Council, Civic Hall, Leeds, LS1 1UR.

The Council and the West Yorkshire Police have a statutory duty to process and maintain licences and permissions and conduct enforcement activities in accordance with the Licensing Act 2003 as part of a legal obligation to meet the statutory requirements for the licensing of the sale of alcohol, regulated entertainment, and late night refreshment.

In addition we will share with external third party organisations including Government departments, Information Commissioners Office (for National Fraud Initiative), the Health and Safety Executive, West Yorkshire Joint Services, Businesses Against Crime in Leeds, Leeds BID and West Yorkshire Fire and Rescue Service to make further enquiries regarding your application under the Licensing Act 2003 or where required by law for the detection and prevention of crime.
The personal information you provide as part of your application for a premises licence, club premises certificate or personal licence will be held for a period of 6 years following the termination of the licence/permit. The personal information held for Temporary Event Notices will be held for a period of 2 calendar years following the event. Details of all transactions are recorded permanently as an entry on the licensing register.
