The council is legally required to publish notices of its intention to appropriate or dispose of any land consisting or forming part of an open space by publishing notices in a local newspaper for two consecutive weeks.

Anybody who wishes to object to the council’s intentions must do so as set out in the relevant notice.

Notice is herby given pursuant to Section 123(2A) of the Local Government Act 1972 that Leeds City Council is intending to dispose of land at Red Hall, Red Hall Lane, Leeds, LS17, which has an area of 42.5 acres or thereabouts to BDW Trading Limited for residential development.

In addition, a copy of the plan is available for inspection at Merrion House Reception (Merrion Way entrance), Merrion House, 110 Merrion Centre, Leeds, LS2 8BB between the hours of 9am and 5pm on Mondays, Wednesdays, Thursdays and Fridays and between 10am and 5pm on Tuesdays.
Objections to the proposed disposal must be made before 16 January 2026 and must be made in writing and addressed to Edward Rowland, Principal Land and Property Officer, Asset Management and Regeneration, City Development, Leeds City Council, Merrion House, 110 Merrion Centre, Leeds, LS2 8BB or by email to Edward.Rowland@leeds.gov.uk quoting reference L&P/EJR/PS-DO-0432-16805EG.
It should be noted that the land being disposed of includes land which is or has been held by the council for the purposes of section 164 of the Public Health Act 1875 and/or in accordance with section 10 of the Open Spaces Act 1906. By virtue of the proposed disposal such land would be freed from any trust arising solely by virtue of its being held in trust for enjoyment by the public.
It should also be noted that the council previously advertised its intention to appropriate the land under section 122(2A) of the Local Government Act 1972 in October 2021. No objections were received in response and on 10 January 2022 the council appropriated the land from recreational use to planning purposes. This notice is therefore given without prejudice to that appropriation having overridden any trust arising from the land having been held in trust for enjoyment by the public.
The council’s intention to dispose of the land is separate from both the proposal to allocate part of the land for development for housing pursuant to the Leeds Local Plan and from the planning application to develop the land (reference 21/04468/FU). Anybody who wishes to object to the proposed disposal of the land must do so as set out above.
